TERMS AND CONDITIONS OF SALE

INTRODUCTIONS, TASTINGS OR SIMPLY GETTING TOGETHER

Preamble

These Terms and Conditions of Sale apply, without restriction or reservation, to all sales made by Cigare et Compagnie.

Cigare et Compagnie is a trading name of PIXIDEA, represented by Cyrille Hure, in his capacity as manager. PIXIDEA is a micro-business exempt from registration with the trade and companies register (RCS) and the trades directory (RM); VAT is not applicable – art. 291 B of the French General Tax Code

registered with the Montauban registry: 81912869500023

Cigare et Compagnie operates as an events business that organises and hosts cigar-themed events – evenings, after-work gatherings, aperitifs, etc. – in restaurants, bars, snack venues and any venue open to the public, but always within the framework of private events in order to comply with current tobacco legislation. To attend these events, tickets are sold remotely via the website www.cigare-et-compagnie.fr

Cigare et Compagnie may also sell products such as merchandise, t-shirts, and smoking accessories.

These Terms of Sale set out, in particular, the conditions for immediate purchase, payment or delivery of tickets ordered.

Ticket offers are subject to availability.

These Terms of Sale apply to the exclusion of any other terms.

The buyer declares to have read these Terms of Sale and to have accepted them before making an immediate purchase or placing an order, it being specified that payment constitutes acceptance of them.

By placing their order, the buyer declares to have read and accepted these terms and conditions of sale.

Article 1: General Conditions

Tickets are neither taken back nor exchanged, except in the case of a date or time error on the ticket, nor refunded in the event of loss or theft. No duplicate will be issued.

Resale is prohibited. The ticket must be presented to staff on arrival at the event.

It is the buyer’s responsibility to check that the order is correct and to report any error immediately.

Cigare et Compagnie sells tickets to both professionals and private individuals.

Cigare et Compagnie therefore reserves the right to refuse purchases of large quantities of tickets by the same buyer.

Ticket buyers are informed that video clips are filmed and photos are taken for Cigare et Compagnie’s communication needs during the event, and their image may therefore appear in them.

By purchasing tickets and taking part in the resulting events, buyers thereby authorise the use of their image. As a result, they may not subsequently hold this use against Cigare et Compagnie, nor use this circumstance to claim any damages entitling them to compensation.

Management reserves the right to change times and programmes. Changes to the programme schedule do not give rise to a refund, except in the event of complete cancellation of the event. In the latter case, only the tickets will be refunded.

A customer’s failure to attend, or any cancellation on their part without valid reason and without having notified Cigare et Compagnie, will not give rise to a ticket refund.

Article 2: Prices

Ticket prices are shown in euros, inclusive of all taxes, including booking processing fees.

PIXIDEA is a micro-business exempt from registration with the trade and companies register (RCS) and the trades directory (RM); VAT is not applicable – art. 291 B of the French General Tax Code

Ticket prices vary for each event given the diversity of services that may take place, and cannot be set in advance.

Article 3: Online booking

The only method of payment accepted is payment by credit/debit card.

Ticket booking is carried out in real time. Our server informs you in real time of availability at the time of your order.

During your booking, the “my cart” page provides a summary of what you are about to order. This page only informs you about the order in progress. This page does not constitute proof of a firm booking. The order is only final once payment by card has been made.

Cigare et Compagnie cannot be held liable for errors made by the buyer when placing their order (contact details, email, incorrect card number).

Payment by card constitutes a firm and final purchase, provided your payment is accepted by your bank. The card payment system is equipped with a security protocol that allows you to carry out your transactions safely.

You will receive an email confirming the purchase of your tickets for the event. This email serves as proof of purchase. We therefore invite you to check your email, save and print the confirmation email. If you do not receive this email, check your spam filter or call us on 06 01 14 27 73.

You will receive your tickets directly in your inbox along with the message confirming your purchase. You will then need to print them and present them at the entrance, or present your mobile phone with the tickets in digital format.

If you do not receive your tickets within a few seconds of payment, please contact us.

Article 4: Modifying or cancelling an order

In the “my account” section, a customer who has already made bookings and whose payment was made by card can add a new order. However, they may under no circumstances modify or remove items from an already paid order themselves. In this case, contact Cigare et Compagnie on 06 01 14 27 73 or place a new order to add tickets to the desired activities, subject to availability.

Any full cancellation of an order must be notified to Cigare et Compagnie by phone and then by email to contact@cigare-et-compagnie.fr

The buyer may cancel their order no later than 48 hours before the date of the event. This must be done by phone on 06 01 14 27 73 and by email to contact@cigare-et-compagnie.fr. The refund will be made by bank transfer within the week following the cancellation, less a 10% deduction from the value of the evening to cover banking fees.

After the 48-hour deadline, for reasons of organisation with outside service providers, no refund will be possible, and Cigare et Compagnie reserves the right to retain the full value of the order without having to justify this.

Should an essential element of a service be changed, or should it be cancelled by Cigare et Compagnie due to a service provider, the buyer, once informed, must either end their booking and obtain a refund, or accept the proposed change.

Failure by the buyer to attend the entrance check, or failure to comply with the rules in force to enter the event, does not entitle them to a refund. Cigare et Compagnie then retains the full amount of the order.

Article 5: Data protection authority (CNIL)

In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify and object to the personal data concerning you. This right may be exercised by writing to us at the following address, stating your first name, last name and address:

Cigare et Compagnie, 2653 route de la margasse, 82370 Campsas

Article 6: Applicable law

These terms and conditions of sale are governed by French law.

Article 7: Disputes

Any dispute relating to the validity, interpretation, performance or termination hereof falls under the jurisdiction of the French courts under ordinary law.

In the event of a dispute with Cigare et Compagnie, in addition to legal action, the buyer may resort to conventional mediation (in particular via the Consumer Mediation Commission or sector-specific mediation bodies) or any other alternative dispute resolution method.

Article 8: Conduct

You must comply with Cigare et Compagnie’s instructions while at the event venue.

Cigare et Compagnie and the venue hosting the event reserve the right to exclude any participant whose behaviour or attitude towards organisers or other participants is inappropriate. No refund will be considered in this case.
